Excerpt from The Railroad Commission in Tennessee: Decision of the United States Circuit Court, Declaring the Law Unconstitutional and Void The complainant claims to be a corporation and citizen of Kentuck and the defendants are the Railroad Commission appointed under, a pursuant to, the act of March 30, 1883. The provisions of this act, so f as they are material, will be recited in the progress of this opinion. It enough, for the present, to say that it purports to vest the defendants wi general supervision of all the railroads and railroad operations in Te nessee. The complainant, who owns and operates several railroads in tl State, contends, first, that said act was not passed in the manner p scribed, and according to the formalities required by the Constitution; if it was, it was not passed in the form in which it has been promulgate and, secondly, if constitutionally enacted, it is repugnant to the State a: Federal Constitutions, and therefore void and inoperative. It furthermo complains that the defendants are about to enforce the same, to its gre detriment and irreparable injury, and prays for an injunction to restr the defendants from interfering, under the color thereof, with its prope or business. Per contra, the defendants insist that the act was regularly passed a promulgated, and that it is, in all of its provisions, within the consti' tional prerogatives of the General Assembly, and a valid enactment; a that the enforcement thereof by them will be no legal wrong of which t complainant has any right to complain.
