Excerpt from United States Circuit Court of Appeals for the Ninth Circuit: Sunset Telephone and Telegraph Company, a Corporation, Appellant, Vs; City of Pomona, a Municipal Corporation, Et Als;, Appellees The Circuit Court held that section 536, if it ever granted a franchise, was repealed by the franchise act Of 1893, and that the section as reenacted in 1905 was re pealed by the reenactment two days later Of the franchise act, except as to lines doing an interstate business. It also held that the section as originally enacted did not in elude telephone corporations, that the lines of the com plainant were telephone and not telegraph lines, and therefore, no question Of contractual or vested rights arose. The court further held that the lines of com plainant in the city of Pomona threatened by the appel lees were not lines doing an interstate business and con sequently the portion Of section 536 enacted in 1905, and not repealed by the subsequent franchise act, did not ap ply to them.
