Excerpt from Reports of Cases Argued and Determined in the Courts of Exchequer and Exchequer Chamber, With Tables of the Names of the Cases and the Principal Matters, Vol. 2: From Michaelmas Term, 2 William IV, 1831, to Trinity Term, 2 William IV, 1832, Both Inclusive Evans and Whitcombe in support of the rule. The items of the common law charges having been allowed by the defendant to be correct on 12 November 1828, before the plaintiff credited the defendant with lw. In satisfaction of those claims on him, the plaintiff 's claim for those charges ceased from that day, and that sum must be taken to have been appropriated to their discharge as well by the defendant as the plaintiff. If so, a debt did not exist after that period for common law charges, as was contended. That account was necessarily separated from the conveyancing bill, for at the time of the settlement in 1828, the defendant.
