Excerpt from Speech of James McDowell, of Virginia, on the Wilmot Proviso: Delivered in the House of Representatives, Tuesday, September 3, 1850 Now, it is well known to the members of this House, that Mr. Madison. In one of the numbers of the Federalist, (38th, ) expressly affirms of this cession of the Northwestern Territory, that it rested upon the necessity of the case alone, and Was entered into by the Congress of the Confeder ation without the shadow of constitutional sanc tion. Mr. Madison does not give the reasons for this opinion, as he need not have done, for no one can read the Articles of Confederation without see ing them.
