In one of the numbers of the Federalist, (38th, ) expressly affirms of this cession of the Northwestern Territory, that it rested upon the necessity of the case alone, and Was entered into by the Congress of the Confeder ation without the shadow of constitutional sanc tion. Mr. Madison does not give the reasons for this opinion, as he need not have done, for no one can read the Articles of Confederation without see ing them.
