Discovery Law is a comprehensive book covering discovery and e-discovery law in Ireland. It deals with the procedure and legal principles arising and covers the new proposals, production of documents, recommended from the Administration of Civil Justice Review Report and e-discovery as well as alternative methods to discovery. It deals with the issue of non-party discovery for the first time. The potential wide ranging implications of the Administration of Civil Justice Review Report in Ireland have not been considered by any text thus far in Ireland. It recommends a complete overhaul of the existing discovery process and urges a 'culture change'. The proposed 'Production of Documents' has not been discussed in any text to date and this text analyses the proposed changes in detail including the draft court rules which are included in the Review. The issue of non-party discovery, as laid out in a recent High Court case, will be dealt with for the first time in this jurisdiction. The textbook includes analysis of discovery in all aspects of civil litigation to include personal injury, family law, multi-party litigation, judicial review and pre-action discovery, to name but a few areas. It analyses the growth of e-discovery and the enforcement of discovery as well as costs and adjudication of such costs. It is a practical must-have book for all practitioners navigating cases in the lower and superior courts in Ireland.

Author Biography:

Maura McNally, Senior Counsel – Consultant Editor Maura McNally is a Senior Counsel and was called to the Inner Bar in 2017, prior to which she practiced on Circuit for 25 years. Following studies at Warwick University (LL.M.), and UCG (B.A. and LL.B), she completed her Bachelors of Law (B.L.) at The King’s Inns. She was called to the Bar of Northern Ireland in 2019. Maura was elected as Chair of the Council of The Bar of Ireland in 2020, becoming the second-ever woman elected to the position, following Ms Justice Mella Carroll who held the role more than four decades ago. Maura practices Civil Law, mainly in personal injury, chancery and non-jury. Gráinne Quinn, Author Gráinne Quinn is a practicing barrister in Dublin and on the Western Circuit. She has extensive experience conducting discovery projects on behalf of the state and for commercial entities. She has a general practice specialising in employment law and criminal law. She has extensive experience in the areas of inter alia, landlord and tenant law, family law and tort. Gráinne holds an LLB (Hons) in Law and European Studies from the University of Limerick, completing a thesis entitled ‘The History, Development and Future of The Right to Silence’. She then completed the Barrister-at-Law Degree at King’s Inns. Gráinne is also an Adjudicator for the Residential Tenancies Board. Gráinne published articles both for Bloomsbury Professional and Irish Law Times, writing the Criminal Law updates for BPrO’s Criminal Law Service.
