This volume is part of a series which brings together a body of documents pertinent to examinations of the early years of the American federal judicial system. This book addresses the cases that the Supreme Court heard in its first five years, 1790 to 1795, with the exception of "Chisholm v. Georgia" and the other suits against states, which formed the focus of the previous volume in the series. It contains a selection of documents and discussions of the legal practice of the period. Each case is treated as a narrative history. With the reconstructed documents, official records and court papers are the related correspondence, newspaper articles and pamphlets. Among the topics covered in this volume are the beginnings of federal admiralty and equity jurisprudence, habeas corpus, judicial review, foreign affairs and the relationship between the national judiciary and state courts. Also included is an appendix of documents pertaining to the question of whether the Supreme Court could issue advisory opinions at the request of the executive branch.
